However, purchasers are solely responsible for ensuring their acquisition and use are consistent with Health Canada requirements applicable to their specific institutional context.

• Health Canada has issued public safety alerts regarding unauthorized injectable peptide products sold online in Canada. True North Performance products are not sold for injection or any form of human administration.
• Precision Regulating amendments to the Food and Drugs Act, which came into force on June 20, 2024, have expanded Health Canada's ability to respond to product safety and availability issues. Purchasers should monitor for regulatory updates that may affect specific compounds.

3. No Health Claims

True North Performance makes no claims, representations, or warranties — express or implied — regarding the therapeutic, medical, or health-related properties of any compound. Under the Food and Drugs Act and the Food and Drug Regulations (C.R.C., c. 870), making health claims about a product without Health Canada authorization constitutes a regulatory violation. Accordingly:

4. Purchaser Eligibility

Products may only be purchased by individuals or entities who meet all of the following criteria:

• Are 18 years of age or older at the time of purchase.
• Are a qualified researcher, scientist, or represent a licensed research institution, accredited academic entity, hospital research program, or registered laboratory operating in Canada.
• Have the legal authority to purchase research chemicals in their province or territory.
• Intend to use the compounds exclusively for lawful, non-clinical, in vitro research.
• Will store and handle all compounds in accordance with applicable safety regulations, institutional biosafety protocols, and Research Ethics Board (REB) requirements where applicable.

5. Regulatory Compliance (Canada)

Purchasers operating in Canada are subject to federal and provincial regulation. It is the purchaser's sole responsibility to determine whether the acquisition, importation, possession, storage, and use of any specific compound is lawful under applicable Canadian law before placing an order.

• Food and Drugs Act (R.S.C. 1985, c. F-27): Governs the sale, advertising, and importation of drugs in Canada. Synthetic peptides may fall within the definition of a "drug" under this Act depending on their intended use and how they are marketed.
• Food and Drug Regulations (C.R.C., c. 870): Sets out requirements for the manufacture, labelling, packaging, and distribution of drugs in Canada, including requirements for Drug Identification Numbers (DINs).

6. Labeling, Handling & Storage

All products are labeled "For Research Use Only — Not for Human or Veterinary Use" in accordance with applicable RUO labeling standards. This designation must be maintained at all times and must not be removed, altered, or obscured by the purchaser.

• Products must be stored under conditions specified on the Certificate of Analysis (CoA) accompanying each shipment.
• Compounds must be handled exclusively by qualified scientific personnel using appropriate personal protective equipment and laboratory safety protocols consistent with institutional health and safety programs.
• Products are not sold with administration accessories. The supply of such items alongside RUO compounds may constitute evidence of intended human use and a violation of Health Canada regulations.
• Purchasers operating within Canadian institutions should ensure their research ethics board (REB) and institutional biosafety committee (IBC) have been consulted where the nature of the research so requires.

7. Limitation of Liability

To the maximum extent permitted by the laws of Canada, including the applicable laws of the province of British Columbia, True North Performance, its officers, directors, employees, agents, suppliers, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the purchase, handling, use, or misuse of any product sold on this website.

This limitation applies regardless of the theory of liability — whether in contract, tort, negligence, product liability, or otherwise — and even if True North Performance has been advised of the possibility of such damages.

The purchaser assumes all risk associated with acquiring and using research chemicals in Canada. By completing a purchase, the buyer agrees to indemnify and hold harmless True North Performance from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable legal fees) arising from:

• The purchaser's use or misuse of any product.
• Any violation of the Food and Drugs Act, the Controlled Drugs and Substances Act, or any other applicable Canadian law by the purchaser.
• Any claim by a third party arising from the purchaser's handling, storage, or application of any product.

8. Governing Law & Jurisdiction

These Terms of Sale are governed by and construed in accordance with the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or in connection with these terms or the purchase of any product shall be subject to the exclusive jurisdiction of the courts of the Province of British Columbia.

If any provision of these terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.

Nothing in these terms limits or excludes any liability that cannot be limited or excluded under the Consumer Protection Act or other applicable mandatory Canadian consumer protection legislation, to the extent such legislation applies.

9. Age Restriction

By completing a purchase, you represent and warrant that you are at least 18 years of age and that you are legally capable of entering into a binding contract under the laws of your province or territory.

True North Performance reserves the right to implement age verification procedures at any time and to cancel or refuse any order where purchaser age or eligibility cannot be confirmed to our reasonable satisfaction.

This restriction is consistent with the intent of Canadian consumer protection legislation and reflects our commitment to responsible distribution of research materials. We do not sell to, or market to, minors under any circumstances.

10. Acceptance of Terms

By placing an order on this website, you confirm that you have read, understood, and agree to be bound by these Terms of Sale and the Research Use Only disclaimer in their entirety.
